Introduction and Overview.

This privacy policy (the “Privacy Policy”) governs your use of the MarineVerse Service, including our website located at www.marineverse.com, our applications including without limitation the MarineVerse Cup, VR Regatta, Big Breezy Boat and Pancake Sailor, as well as our associated services (the “MarineVerse Services”).

MarineVerse (VIRTUAL REALITY SAILING PTY LTD ABN: 89616895820) of 3183 Balaclava, Victoria, Australia (“we”, “us”, “our”) are committed to providing quality services to you. This Privacy Policy details how we comply with the Privacy Act 1988 (Cth) (the “Privacy Act”), the Australian Privacy Principles (“APPs”) and to the extent that it applies, the EU General Data Protection Regulation 2016/679 (“GDPR”), in relation to the way in which we collect, use, disclose, store, secure and dispose of your information and data.

Please read this Privacy Policy and MarineVerse Terms of Use carefully before using the Marineverse Services. If you do not agree with any part of this Privacy Policy, please do not use the Marineverse Services.

Information we collect

This Privacy Policy covers all information collected via your use of the Marineverse Services. The information we may collect from you can be broken down into the following categories:

“Personal Information” is information or an opinion that identifies (or can be used to identify) an individual. Examples of Personal Information we collect include names and email addresses or individual user progress and results in “MarineVerse Services”.

“Sensitive Information” is a special type of Personal Information that relates to health information, or information or opinions relating to your beliefs, sexual orientation, ethnicity, membership of any political party or trade association, or criminal record. We will not collect Sensitive Information expect with your prior written consent, and only where such collection is necessary to provide the Marineverse Services to you.

“Usage Information” means anonymous aggregate data that may be automatically collected through your use of the Marineverse Services. This includes information that may identify your device, your operating system, your IP address, and dates and times that you access and use the Marineverse Services. This information is primarily used to resolve any technical issues that may arise, or for statistical analysis to help us to improve the Marineverse Services.

The GDPR recognises that Usage Information, whilst for the most part anonymous, can be cumulatively used to directly or indirectly identify you. Usage Information that can be used to identify you in any way, together with your Personal Information, shall collectively be referred to in this Privacy Policy as “Personal Data”.

Use of Information

We collect your Personal Data for the primary purpose of providing the Marineverse Services to you. We may also use your Personal Data for secondary purposes closely related to the primary purpose, in circumstances where you would reasonably expect such use or disclosure.

You agree that we may use your Personal Data for our legitimate business purposes, including to:

  • Operate and manage the Marineverse Services, including your registration and account, racing and leaderboards, membership list.
  • Respond to your comments, questions, and requests, and provide customer service.
  • Send you product notices and updates, for example results of racing, start and end of competitions, etc.
  • Send you technical notices, updates, security alerts, information regarding changes to our policies, and support and administrative messages.
  • To confirm your identity, and prevent and address fraud, breach of policies or terms, and threats or harm.
  • To comply with legal and regulatory requirements.
  • Monitor and analyze trends, usage, and activities.
  • Conduct research, including focus groups and surveys.
  • Improve the MarineVerse Services and our other products and services.
  • Develop and send you direct marketing, including advertisements and communications about our and other entities’ products, offers, promotions, rewards, events, and services.
  • Fulfill any other purposes where we have a legal basis to process your Personal Data, or otherwise at your direction or with your notice and/or consent.

‘Opt Out’

We recognise your right under the Spam Act 2003 (Cth) and the GDPR to opt out from direct marketing, and as such these consents can be modified at any time by emailing privacy@marineverse.com or clicking unsubscribe on any direct marketing communications.

Please note certain non-marketing related correspondence from us, including messages relating to your account, will be automatically sent to you by virtue of your use of the Marineverse Services and you may not have the option to unsubscribe from receiving this correspondence.

Personal Data Removal

You can request deletion of your account by navigating to "Account" tab at https://www.marineverse.com/my-profile and clicking "Delete Account" button. Deleting your account with result in removal of your data from our systems.

You can also request your data to be deleted by contacting us at privacy@marineverse.com.

Your data will be removed as soon as practical, within 30 days.

How We Collect Information

To provide the Marineverse Services to you, we will collect and process your Personal Data. The following is a breakdown of our collection practices based on what you provide to us, information collected automatically, and information received from other sources necessary for us to provide you with the Marineverse Services.

It is your choice to provide Personal Information to us. Wherever it is lawful and practicable, you have the option not to identify yourself when interacting with us. Please be aware that it may be necessary for us to collect your Personal Information to enable us to provide the Marineverse Services to you. As such, if you do not wish to provide your Personal Information, this may limit our ability to provide the Marineverse Services to you.

A. Information You Provide.

  • Contact Data, including your email and postal address provided when you interact with the Marineverse Services.
  • Account Credentials, for example your password (in encrypted hashed form).
  • Username, Avatar  from services you connect to your MarineVerse account, for example Twitter, Ready Player Me or Steam.
  • Content, including content you post in your MarineVerse profile or on our Discord channels.

B. Information Collected Automatically.

In addition, we automatically collect certain types of Usage Information when you use the MarineVerse Services. The categories of Usage Information we may automatically collect include without limitation:

  • Service Use Data, including data about features you use, pages you visit, products and services you view and purchase, the time of day you browse or play, and your referring and exiting pages.
  • Device Data, including data about the type of device or browser you use, your device’s operating software, your internet service provider, your device’s regional and language settings, and device identifiers such as IP address.
  • Location Data, including imprecise location data (such as location derived from an IP address).

We use various tracking technologies to automatically collect information when you use the MarineVerse Services, including without limitation:

  • Log Files, which are files that record events that occur in connection with your use of the Marineverse Services.
  • Cookies, which are small data files stored on your device that act as a unique tag to identify your browser. We use two types of cookies: session cookies and persistent cookies. Session cookies make it easier for you to navigate our website and expire when you close your browser. Persistent cookies help with personalizing your experience, remembering your preferences, and supporting security features. Persistent cookies may remain on your device for extended periods of time, and generally may be controlled through your browser settings.
  • Pixels,(also known as web beacons), which is embedded code that sends information about your use to a server. There are various types of pixels, including image pixels (which are small graphic images) and JavaScript pixels (which contains JavaScript code). When you access a website or email that contains a pixel, the pixel may permit us or a separate entity to drop or read cookies on your browser. Pixels are used in combination with cookies to track activity by a particular browser on a particular device. We may incorporate pixels from separate entities that allow us to understand your use of our websites and emails, and provide you with additional functionality.

C. Information from Other Sources..

We also collect information from other sources. The categories of sources we may collect information from include without limitation:

  • Social networks when you engage with our content, reference our Service, or grant us permission to access information from the social networks.
  • Gaming platforms, like Steam or Meta when you engage with our content, reference our Service, or grant us permission to access information from the gaming platform.
  • Third parties where you have consented for a third party to share information with us; where we are authorised by law to collect the information from a third party or where it is unreasonable or impracticable to collect the information from you personally.

If we collect your Personal Information from third parties in circumstances where you may not be aware that we have collected such Personal Information, we will take reasonable steps to notify you of the collection and circumstances surrounding the collection.

Third Party Sites

The Marineverse Services may contain plug-ins and links to third party sites to enhance your user experience, including our Third Party Distributor Platforms (as that term is defined in our Terms of Use). We do not have access to, or control over, the technologies that third parties may use to collect information about you. Please refer directly to the privacy policies and statements of the operator of any third parties to obtain information regarding their data collection, use, and disclosure policies. We disclaim all liability in connection with the services of any third party sites, plug-ins or services integrated or otherwise linked to the Marineverse Services, and we encourage you to reach out to them directly should you have any questions in connection with their services. Disclosure of Information

You agree and consent to us disclosing your Personal Data to:
  • Third party service providers who work on our behalf for the purposes described in this Privacy Policy, provided that such third parties agree to provide at least the same level of privacy protection as required by this Privacy Policy. These services may include providing cloud computing infrastructure, analytics, website crash reporting, and providing customer support or account administration. Some of our service providers include:
    • Heroku / Salesforse.
    • Amazon Web Services, Inc.
    • Vercel Inc.
    • SolarWinds Worldwide, LLC
  • Our directors, officers, employees, consultants, contractors and agents;
  • Our Related Bodies Corporate (as that term is defined in the Corporation Act 2001 (Cth));
  • External counsel for the purpose of obtaining professional advice;
  • Potential investors and financiers;
  • Government and regulatory authorities;
  • Third parties where you consent to the use or disclosure; and
  • Where required or authorised by law, or otherwise to prevent harm.

Security of Personal Data

Your Personal Data is stored in a manner that reasonably protects it from misuse and loss and from unauthorised access, modification or disclosure. No security measures are, however, 100% secure so we cannot guarantee the security of your information or data at any time. To the extent permitted by law, we accept no liability for any breach of security, or direct hacking of our security measures, or any unintentional disclosure, loss or misuse of any information or data, or for the actions of any third parties that may obtain any information or data.

Notwithstanding the above, we acknowledge our obligation to report any data breach that is likely to risk the rights and freedoms of natural persons to the Australian Information Commissioner and, where our data breach involves the information of EU subjects, report to the European Data Protection Supervisor. We will also inform you, where possible, if your data has been breached in the circumstance where it poses a risk of serious harm or your rights and freedoms.

When your Personal Data is no longer needed for the purpose for which it was obtained, we will take reasonable steps to destroy or permanently de-identify your Personal Data. However, most of the Personal Data is or will be stored in client files which will be kept by us for a minimum of 7 years (or longer retention period as required by law).

Access to Your Information

You may access the Personal Information we hold about you and to update and/or correct it, subject to certain exceptions. If you wish to access your Personal Information, please contact us at privacy@marineverse.com.

In accordance with the GDPR, we acknowledge the additional rights of EU subjects to:

  • have their Personal Data erased that is no longer being used for a legitimate purpose;
  • request a copy of all Personal Data held about them in a readable format, along with supplementary information to verify that such Personal Data is being processed lawfully; and
  • request restricted processing of their Personal Data whilst any complaints or concerns are being resolved.

To erase, request, or restrict processing of your Personal Data, please email privacy@marineverse.com. You can also request deletion of your account by navigating to "Account" tab at https://www.marineverse.com/my-profile and clicking "Delete Account" button.

MarineVerse will not charge any fee for your access request, but may charge an administrative fee for providing a copy of your Personal Data.

In order to protect your Personal Data we may require identification from you before releasing the requested information.

Maintaining the Quality of your Personal Information

It is an important to us that your Personal Information is up to date.

We will take reasonable steps to make sure that your Personal Information is accurate, complete and up-to-date. If you find that the information we have is not up to date or is inaccurate, please advise us as soon as practicable so we can update our records and ensure we can continue to provide quality services to you.

Children

The MarineVerse Service is intended for a general audience, and is not directed at children under 13 years of age. We do not knowingly collect Personal Information of persons under eighteen (18) years of the age without their parent and/or guardian’s consent. If you are a parent or guardian and you believe we have collected information from your child in an unauthorised manner, contact us at privacy@marineverse.com.

If you are a California resident under 18 years old and registered to use the Marineverse Services, you can ask us to remove any content or information you have posted on the Marineverse Services in accordance with the U.S. Children’s Privacy Protection Act (“COPPA”). To make a request, email us at privacy@marineverse.com with “California Under 18 Content Removal Request” in the subject line, and tell us what you want removed. We will make reasonable good faith efforts to remove the post from prospective public view, although we cannot ensure the complete or comprehensive removal of the content and may retain the content as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements.

Policy Updates

We may update and change this Privacy Policy from time to time at our sole discretion. Any variations become effective on posting the updated Privacy Policy on our website. Your continued use of the Marineverse Services following the publication of any amended Privacy Policy shall signify your acceptance of that amended Privacy Policy, except where we are otherwise obliged by law to seek your direct consent.
